2. Purchase and Order

2.1 Procurement Process: Our services can be purchased by diligently filling out the online order form at https://classification.codes/store/selection/.
2.2 Commitment to Pay: Upon completing the order form, you confirm your intent to purchase our services and are legally bound to pay all associated fees, including but not limited to, taxes, service charges, and any additional costs.
2.3. Price Exclusion: All prices displayed in the online order form are exclusive of VAT.

3. Content and Intellectual Property

3.1 Our Rights: Except for third-party content, elements like the design, layout, appearance, graphics, and all other content on our Services are owned by or licensed to us and are safeguarded by international copyright laws.
3.2 Mapping Service Know-How: Beyond the specific content, our unique methodology and know-how used in creating and delivering the mapping service are proprietary intellectual property belonging to our company.
3.3 Classification Mappings: Our classification mappings utilize publicly available data. Such data is sourced from statistical offices of various countries, and the intellectual property rights for this data belong to these entities. While we provide access and mapping services, we don't claim ownership over this data.
3.4 External Classifications: When you provide an external or third-party classification to us for the purpose of mapping, you must have the appropriate rights to use and share such classifications. Additionally, by doing so, you grant us temporary rights to process, use, and map these classifications, strictly for the purpose of fulfilling the service.

4. Mapping Licenses

4.1. Definitions and Clarity:
- Standard License: This is the default license attached to all mappings displayed with pricing at https://classification.codes/store/selection/. Under this license, the mappings are strictly for the internal use of the purchasing individual or the company they represent. The use is confined to the company's private operations and cannot be displayed, shared, or distributed externally.
- Extended License: Customers requiring broader usage rights, such as sharing the mapping data with external third parties, business partners, or clientele, must opt for this license. The specific cost of the Extended License can vary based on several considerations, such as the purpose of the mapping, the number of entities it's shared with, its distribution medium, and more. Customers interested in this license should contact us for a tailored quote.
4.2. Reselling and Redistribution Restrictions:
- Reselling Prohibition: Reselling our mapping data or using them in a product/service for resale is strictly forbidden under both the Standard and Extended licenses.
- Permission for Resale: A customer may resell or profit from our mapping data only with our explicit prior written approval. This approval, if granted, would outline the specific terms and conditions under which the resale or profit-making activities can take place. Unauthorized resale or profit-making activities using our mapping data, outside of the conditions laid out in the approval, are considered a severe violation of these terms.
4.3. Penalties for Unauthorized Use: Breaching our licensing terms, especially in cases of unauthorized resale or redistribution, can result in significant penalties. Depending on the severity and extent of the violation, penalties can amount up to 1,000,000 EUR exclusive of VAT. We reserve the right to pursue legal action against entities that misuse our intellectual property or violate our licensing terms.
4.4. Rights of Review and Audit: We reserve the right to review how our mapping data is being used by customers. If necessary, we may request evidence of appropriate license use, especially if there's suspicion of a license breach. Cooperation with such reviews is mandatory, and failure to comply may result in license revocation and penalties.

5. Exclusion of Liabilities

5.1. Service Assurance: Our Services are provided "as is" and "as available", with no express or implied warranties of any kind, including, but not limited to, functionality, suitability, or availability.
5.2. Decision-making Reliance: Any actions or decisions made based on our Services are taken at the User's sole discretion and risk. We disclaim all liabilities from such actions or decisions.
5.3 Responsibility Waiver: We bear no responsibility for decisions, financial or otherwise, made based on the information or services obtained through Classification Codes. Users are encouraged to seek independent professional advice before making significant decisions.

6. Right to Refuse Service

6.1 Sole Discretion: We hold the sole discretion to decline service to any individual or organization. This can be due to concerns over intellectual property, evidence of illegal intent, or any other reason deemed appropriate by us.
6.2 Finality of Decision: Our judgment to refuse service is irrevocable. While we may provide an explanation, we are under no obligation to do so.
